Communication to the Ministry of Labor of Peru.

The Association for Social and Agro-Environmental Development in Peru was established to develop the Peruvian economy and improve employment opportunities for people in Peruvian society. Our organization will work diligently to develop resources to help those who need to find work

The first project after the establishment of our organization was to contact international deep-sea fishing companies to obtain international job opportunities for Peruvian seafarers. We sincerely hope that the Peruvian government can support our work. In the international dispatch project for seafarers, we expect that the Ministry of Labor of Peru and the Maritime Administration of Peru can provide strong support to protect the legitimate rights and interests of our Peruvian seafarers

De acuerdo con el espíritu rector del «CONVENIO SOBRE EL TRABAJO MARÍTIMO, 2006», nuestra organización se centrará en los siguientes puntos como objetivos clave de seguimiento: la gente de mar peruana recibe un trato justo en la contratación y el trabajo; están más seguros al recibir sus salarios a tiempo; y la labor de los marinos peruanos es la vigilancia ambiental en temas de seguridad y salud.

The specific oversight program of our organization is:

  1. With the Association for Social and Agro-Environmental Development in Peru as the representative of the crew organization, when Peruvian crew members sent by us encounter any unfair treatment, there is no need to confront the issue on behalf of individual crew members. Our crew dispatch organization will request a solution from the shipowner organization for the legitimate rights and interests of the Peruvian crew until the matter is resolved.
  2. Implement a third-party wage payment guarantee to prevent the shipowner organization from failing to pay the crew’s wages on time for various reasons, which would affect the rights and interests of the crew.
  3. During the port call of an international ship where Peruvian crew members will board, our organization will conduct a prior observation of the vessel before the Peruvian crew members embark. If it is determined that the working and living conditions for the crew on the ship do not meet the requirements of Peruvian Labor Law or.. «CONVENIO DEL TRABAJO MARÍTIMO, 2006»our organization will submit a request to the Ministry of Labor of Peru or the Maritime Administration of Peru for inspection and confirmation of the vessel. If the maritime agency confirms that the issues we raised are valid, we will present rectification requirements to the shipowners' organization. Without the approval of the shipowners' organization, our crew organization will refuse to allow the embarkation of Peruvian crew members until the living and working environment on the ship complies with the legal standards.
  4. In accordance with the guidance requirements of the «CONVENIO SOBRE EL TRABAJO MARÍTIMO, 2006», Crew dispatch organizations must operate under the strict supervision of the government of the country of origin

Our organization will strictly comply with the requirements of the dispatchers under the International Maritime Labor Convention, specifically the following

  1. Our crew dispatch organization is a social group and a non-profit organization.
  2. Our international crew dispatch projects are all legal entities registered in the National Registry of Peru. Furthermore, this dispatch project is a legal project recorded with the Ministry of Labor of Peru, registered and certified by the Ministry of Foreign Affairs of Peru and the Peruvian Consulate in China, and certified before a notary by the Office of Foreign Affairs in China and the notary in China
  3. In accordance with the requirements of the «CONVENIO SOBRE EL TRABAJO MARÍTIMO, 2006»we have contracted a third-party financial guarantee agency for the crew to ensure that the legitimate interests of the crew are protected
  4.  Our organization promises to take into account the legitimate rights and interests of crew members and to actively assist them in resolving issues when they arise.

Here, our organization of Peruvian crew members hopes to receive support from the Ministry of Labor of Peru for the Peruvian crew dispatch project, and to send our appeal to the Peruvian maritime agency so that we can obtain support from the Peruvian maritime regulatory agency
